DAY EXCURSION  TERMS AND CONDITIONS   1. ERRORS & OMISSIONS   Every effort has been made to ensure the accuracy of the information in our brochure and is correct at the time of printing;  unf ortunately we cannot  accept responsibility for any errors or omissions.     2. COMPANY LIABILITY   New Horizon Travel ltd does not accept any responsibility for loss, damage, delay or inconvenience caused to passengers when  tra velling on one its  Day Excursions.  All arrangements for meals, refreshments, entertainment or other means of travel such as ferry or train by E uro tunnel are made by  the Company as agents for or on behalf of the passengers on the condition that the Company shall not be responsible for any l oss , damage, delay or  inconvenience caused to passengers as a result of such arrangements.     3. CANCELLATION BY THE COMPANY   It is necessary for there to be a minimum number of passengers in order to operate a day excursion. If this minimum number is   no t achieved the  excursion could be cancelled. The Company reserves the right to cancel any excursion at any time for whatever reason, but wil l e nsure that  passengers are advised where possible not less than 7 days prior to the departure date. All monies paid for that particular e xcu rsion will be refunded  in full and following that, the Company shall be exempt from any further liability     4. CANCELLATION BY THE CUSTOMER    If you or any member of your party have to cancel, the person who made the original reservation must contact us via the Offic e a t which you made  your booking and confirm the cancellation in writing. A refund less an administration charge of £5.00 per seat shall be made  in  accordance with the  following scale.    Refund amount:   More than 14 days =  90%     < - > 14 to 7 Days =  50%   < - > Less Than 7 Days =  No Refund  (unless seat resold = 50%)        5. COACH AND SEAT AL LOCATIONS   The Company reserves the right to substitute another vehicle (including those of other operators) for all or part of the excu rsi on.  A change of  vehicle may be necessary if the Company is to substitute a small coach or mini coach due to low passenger numbers.   Seats will be agreed and allocated at time of booking and detailed on your confirmation, those seats will be kept for the dur ati on of the tour. For  operational reasons a coach of different seat configuration may be used and New Horizon Travel Ltd therefore reserve the righ t t o allocate seats  other than those you have booked without prior notice. Seats are not allocated on feeder journeys.    Please note that we must be  informed on  booking if any persons may require the use of a seat belt extension whilst on any trip.     6. BREAKDOWNS, DELAYS & WEATHER CONDITIONS   New Horizon Travel Ltd will aim to operate in all weather conditions. In the event of serious weather conditions, for example   he avy snowfall, no  refunds can be given for cancellations. However, in these circumstances, each individual excursion will be assessed with rega rd  to refunds. The  Company gives its advice on journey times in good faith. However, as a result of breakdown or traffic congestion, or other ev ent s beyond the  reasonable control of the Company, journeys may take longer than predicted and in those circumstances the Company will not be   li able for any loss  or inconvenience suffered by the passenger as a result.      7. SMOKING & ALCOHOL   We do not permit smoking or drinking alcohol on the coach during day trips. Should anyone be found to be smoking or drunk the y w ill be asked to  leave the coach to avoid upsetting the remaining passengers.     8. CHILD SEATS    All passengers regardless of age must be allocated a seat on the coach. It is the responsibility of the accompanying adult to   pr ovide and secure a  suitable child seat, if you have any queries regarding the suitability of the seat or the seat belts fitted on the vehicle pl eas e ask when booking. New  Horizon Travel ltd will not accept any responsibility for the fitting a child seat and children may be refused travel without   th e appropriate restraint.  Children who qualify for free entry in to chargeable venues will have the price reduced to reflect this. Child’s age is up to   12   years old.      9. HOT DRINKS   Hot drinks will only be served on Day Excursions when two drivers are on board, the hot drinks facility on coaches are not to   be   used by  passengers due to health and safety concerns.     10. CONTINENTAL DAY EXCURSIONS   Passports are essential for all continental excursions. Citizens of non - EC countries must ensure they have the necessary visa an d any other  documents required to enter all countries to be visited. The amount of goods purchased in the E.U. by passengers and allowed  to  enter the U.K.   will be subject to U.K. Customs legal allowances. The Company reserves the right to continue its onward journey without any p ass engers detained  at customs for non compliance with the above regulations     11. LUGGAGE / PASSENGERS PROPERTY   We will not be responsible for loss or damage of personal property. Any lost property, except those of a perishable nature (w hic h will be disposed  of at our discretion) will be subject to the current Public Service Vehicle (Lost Property) Regulations. If you require the i tem s to be posted there  will be a minimum charge of £5.00 for Postage & Packaging. We reserve the right to refuse any articles of a dangerous or unde sir able nature.     12. COMPLAINTS   In the unlikely event of you having a complaint whilst on one of our day excursions you should inform the driver who will do  his   best to resolve  the problem. Should you feel the problem was not resolved satisfactorily you should advise us in writing within 7 days of you r e xcursion.     13. FORCE MAJEURE   We regret that we cannot accept liability or pay any compensation where the performance or prompt performance of our contract ual   obligations is  prevented or affected by, or you otherwise suffer any damage or loss as a result of, “force majeure”. In these booking condit ion s, “force majeure”  means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. S uch   events may include  (whether actual or threatened), but are not limited to, unavoidable technical problems with transport, war, riot, civil strif e,  terrorist activity,  industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemic or fire and all similar events or circu mst ances outside our  control. 1.
